Terms and Conditions of Sale for Varun e-bike Online Store

 

  1. Scope

These Terms and Conditions of Sale apply to all orders placed in our online store. Our online store is exclusively open to consumers.

 

A consumer is defined as any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. An entrepreneur is a natural person, legal entity, or partnership that, when entering into a legal transaction, is acting in the exercise of its trade, business, or profession.

 

  1. Contracting Parties, Contract Formation, and Correction Options

The purchase and sale contract is concluded between Varun e-bike and you.

 

Product displays in the online store do not constitute legally binding offers but are non-binding online catalogs. You can place products in your shopping cart and correct them at any time before submitting a formal order using the correction options provided during the order process. By clicking the order button, you submit a binding offer concerning the goods in your shopping cart. You will receive an immediate confirmation email regarding the receipt of your order.

 

We will accept your offer within 1 day by either:

 

Sending a separate email of acceptance, or

Executing the payment transaction by our service provider or the selected payment service provider. The timing of the execution of the payment transaction depends on the selected payment method (see "Payment Methods"). The specific option that applies depends on which event occurs first.

 

  1. Contract Language and Contract Text Storage

We store the contract text and send the ordering data and our Terms and Conditions to you in written form. The contract text is no longer accessible via the internet for security reasons.

 

  1. Delivery Conditions

There will be no additional costs or shipping fees apart from the indicated product prices.

We only deliver through shipping methods. Unfortunately, customers cannot pick up the goods themselves.

 

  1. Payment Methods

In our store, you can typically choose from the following payment methods:

 

Credit Card

During the order processing, you will enter your credit card information. Your credit card will be charged immediately after the order is submitted.

 

PayPal

We cooperate with the payment service provider PayPal ("PayPal") to offer you the following payment options as part of the PayPal service. To make payments through PayPal, you must be registered with PayPal, authenticate yourself using your login credentials, and confirm the payment instruction. The payment transaction will be executed immediately by PayPal after the order is submitted.

 

PayPal may offer additional payment methods to registered PayPal customers who have selected them according to their own standards. We have no influence on providing these methods; additional personalized payment methods involve legal relationships between you and PayPal. Instalments via PayPal

We cooperate with PayPal to offer you the opportunity to pay in instalments. This is subject to a successful credit assessment. Klarna

Your account will be debited immediately upon order submission. Klarna also offers you the opportunity to pay in instalments, subject to a successful credit assessment. For more information, please refer to the instructions during the ordering process.

 

  1. Retention of Ownership

The goods remain our property until full payment is received.

 

  1. Transport Damage

If obvious transport damage occurs, please report it to the delivery agent immediately and contact us promptly. Failure to make a complaint or contact us will have no effect on your legal rights and benefits, especially warranty rights. However, it assists us in asserting our own rights against the carrier or transport insurance company.

 

  1. Warranty and Guarantees

8.1 Statutory Liability for Defects

Unless expressly agreed otherwise, statutory liability for defects applies.

 

Consumer Notice

We hereby inform you that, when selling used goods to consumers, we can reduce the warranty period to 180 days from the date of delivery, provided we inform you explicitly and obtain separate consent.

 

This provision does not apply to claims for damages based on injury to life, body, or health caused by us, our legal representatives, or agents due to:

 

Intentional or grossly negligent breaches of duty, as well as fraudulent intent.

Material contractual obligations, the fulfillment of which is essential for the proper execution of the contract and on which the contracting party regularly relies (essential contractual obligations).

Liability within the scope of guarantees, if any, or liability under the Product Liability Act.

 

8.2 Guarantees and Customer Service

Information about any additional guarantees that may apply and their exact conditions can be found in the products as well as on the special information page of the online store.

 

  1. Liability

We always bear unlimited liability for claims for damages caused by us, our legal representatives, or agents based on:

 

Injury to life, body, or health.

Intentional or grossly negligent breaches of duty.

Liability within the scope of guarantees, if any, or liability under the Product Liability Act.

 

For breaches of insignificant contractual obligations due to slight negligence by us, our legal representatives, or agents, liability is limited to the foreseeable amount of damages typical for this type of contract at the time of concluding the contract. Otherwise, liability is excluded for claims for damages.
